Terms of Use — Dress Live

1. Who we are

The Dress Live application (the “App”) and the website are published by ecosysteme.ai, 55 Parc de Monceau, 75008 Paris, France (“Dress Live”, “we”, “us”). Contact: contact@ecosysteme.ai.

2. Acceptance

By creating an account or using the App you agree to these Terms of Use and to our Privacy Policy, which explains how we handle your data — in particular your photos and body measurements. If you do not agree, please do not use the App. Boutiques that use the professional features of Dress Live are additionally bound by a separate boutique agreement.

3. The service

Dress Live helps you find clothing that fits, remotely:

AI Try-On — from one photo of you, our AI renders a garment on your body so you can see how it looks.
AI Measurements — from one photo, our AI estimates your body measurements and recommends a size for each garment.
Live Try-On — a real-time video appointment with an advisor from a partner boutique, during which garments the advisor suggests are rendered on you live.
Virtual wardrobe — save favourites and try-on results, combine looks, and reserve or order items from partner boutiques.

Dress Live is a platform. Partner boutiques are independent businesses; unless expressly stated otherwise, Dress Live is not the seller of the items shown in the App (see section 9).

4. Eligibility & account

You must be at least 15 years old to use the App. If you are under 18, you confirm that a parent or guardian has agreed to these Terms on your behalf.
You need an account to use most features. You can register with your email address, with Sign in with Apple or with Google Sign-In. Provide accurate information and keep it up to date.
Keep your credentials confidential. You are responsible for activity on your account; tell us immediately at contact@ecosysteme.ai if you suspect unauthorised use.
You may delete your account at any time in the App (Profile → Settings → Account → Delete account) or as described on our account deletion page.

5. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your personal, non-commercial use, in accordance with these Terms and the usage rules of the app store from which you obtained it. You may not copy, modify, distribute, sell, rent, reverse-engineer or decompile the App, or extract its source code, except where the law expressly permits it.

6. Your photos & content

You keep all rights to the photos you upload. You grant us a non-exclusive, worldwide, royalty-free licence to host, process, adapt (for example to render a garment on your photo) and display your photos and the resulting images solely to provide the App’s features to you and to any boutique you choose to share them with. This licence ends when you delete the content or your account, subject to the retention periods in our Privacy Policy.
Only upload photos of yourself, or of another adult who has expressly agreed. Do not upload photos of minors other than yourself.
Do not upload content that is unlawful, sexually explicit, hateful, or that infringes someone else’s rights.
We do not use your photos to train our AI models without your separate, explicit opt-in consent.
We may remove content that violates these Terms and, in serious or repeated cases, suspend or terminate your account.

7. AI results

Renderings and size recommendations are estimates

AI Try-On images are computer-generated simulations. Colours, fabric drape, fit and proportions may differ from the real garment. AI Measurements and size recommendations are estimates based on your photo and on the boutique’s size chart; they are not a guarantee that a garment will fit. Always check the boutique’s size guide and return conditions before buying, and where possible confirm the size with the boutique advisor.

AI results depend on the quality of your photo (lighting, pose, fitted clothing, full body visible). We continuously improve our models, so results may change over time.

8. Live Try-On

Live Try-On appointments are provided by partner boutiques through the App. Availability depends on the boutique.
Be respectful during appointments. Harassment, discriminatory or sexual remarks, or any abusive behaviour towards boutique staff — and, for boutiques, towards customers — lead to suspension.
Dress Live does not record video appointments. You may not record, screenshot or share an appointment involving another person without that person’s consent.
The advisor speaks on behalf of the boutique, not of Dress Live. Advice given during an appointment is the boutique’s.
Please cancel appointments you cannot attend, in the App, as early as possible.

9. Purchases from boutiques

When you reserve or order an item through the App, the sales contract is concluded between you and the boutique. The boutique is responsible for the description, price, availability, delivery, invoicing, returns and warranty of the item, under its own terms and conditions, which are shown to you before you confirm.
Payments are processed by the boutique or its payment provider. Dress Live does not store your card details.
Your statutory consumer rights — including, where applicable in the EU, the 14-day right of withdrawal for distance sales and the legal guarantee of conformity — are not affected by these Terms and are exercised against the seller.
The App is free of charge for shoppers. Dress Live does not currently offer in-app purchases or subscriptions to shoppers. If this changes, prices and conditions will be shown clearly before any payment.

10. Acceptable use

You agree not to: use the App for any unlawful purpose; interfere with its operation or security; access it by automated means (scraping, bots) or attempt to access other users’ accounts or data; use try-on images to impersonate or harass anyone; resell or commercially exploit the App or its output without our written consent; or use the App to develop a competing product.

11. Intellectual property

The App, its software, AI models, design, texts, graphics, logos and the Dress Live name are owned by ecosysteme.ai or its licensors and are protected by intellectual-property laws. Garment images, brand names and product descriptions belong to the boutiques and brands concerned. Nothing in these Terms transfers any of these rights to you. Try-on images generated for you may be used for your personal, non-commercial purposes.

12. Availability & changes

We aim to keep the App available at all times but cannot guarantee uninterrupted service; maintenance, updates or events outside our control may cause interruptions. We may add, change or remove features. The App may be offered as a beta or in open testing, in which case features may be incomplete and change without notice. We may update these Terms; if the changes are material we will inform you in the App or by email at least 30 days before they take effect. Continuing to use the App after that date means you accept the new Terms.

13. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your account if you breach these Terms, if required by law, or if we discontinue the App — in the last case with reasonable notice. Sections 6 (licence to content, for the retention period), 11, 14 and 16 survive termination.

14. Liability

We provide the App with the care of a diligent professional. To the extent permitted by law, we are not liable for: the fit, quality, delivery or conformity of items sold by boutiques; the advice given by boutique advisors; differences between AI renderings or size recommendations and the real garment; interruptions caused by your device, network or third-party services; or indirect losses such as loss of data or opportunity.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or gross negligence, or any other liability that cannot be excluded under applicable law, including your statutory rights as a consumer.
You are responsible for your use of the App and for the content you upload, and agree to hold us harmless from claims by third parties arising from your breach of these Terms.

15. App Store & Google Play

If you downloaded the App from the Apple App Store, the following also applies: these Terms are concluded between you and ecosysteme.ai only, not with Apple; Apple is not responsible for the App or its content and has no obligation to provide maintenance or support; in the event of the App’s failure to conform to any applicable warranty you may notify Apple, which will refund the purchase price (if any), and Apple has no other warranty obligation; Apple is not responsible for addressing any claims relating to the App, including product-liability, regulatory or intellectual-property claims; you confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties; you must comply with applicable third-party terms when using the App; Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

If you downloaded the App from Google Play, Google’s terms of service and usage rules for Google Play also apply. Google is not a party to these Terms and is not responsible for the App.

16. Governing law & disputes

These Terms are governed by French law. If you are a consumer residing in another country of the European Union or in Switzerland, you also benefit from the mandatory consumer-protection provisions of your country of residence, and you may bring proceedings before the courts of that country.

If you have a complaint, please contact us first at contact@ecosysteme.ai — we will try to resolve it within 30 days. As a consumer you may also use a consumer mediation service free of charge, under Articles L.611-1 et seq. of the French Consumer Code, and the European Commission’s online dispute-resolution platform at ec.europa.eu/consumers/odr.

2. Geltung

Mit der Erstellung eines Kontos oder der Nutzung der App stimmen Sie diesen Nutzungsbedingungen und unserer Datenschutzerklärung zu, die erläutert, wie wir mit Ihren Daten – insbesondere Fotos und Körpermaßen – umgehen. Wenn Sie nicht einverstanden sind, nutzen Sie die App bitte nicht. Boutiquen, die die professionellen Funktionen von Dress Live nutzen, unterliegen zusätzlich einer gesonderten Boutique-Vereinbarung.

3. Der Dienst

Dress Live hilft Ihnen, aus der Ferne Kleidung zu finden, die passt:

AI Try-On – aus einem Foto von Ihnen stellt unsere KI ein Kleidungsstück an Ihrem Körper dar, damit Sie sehen, wie es aussieht.
AI Maße – aus einem Foto schätzt unsere KI Ihre Körpermaße und empfiehlt für jedes Kleidungsstück eine Größe.
Live Try-On – ein Videotermin in Echtzeit mit einer Beraterin oder einem Berater einer Partnerboutique, bei dem vorgeschlagene Kleidungsstücke live an Ihnen dargestellt werden.
Virtuelle Garderobe – Favoriten und Anprobe-Ergebnisse speichern, Looks kombinieren sowie Artikel bei Partnerboutiquen reservieren oder bestellen.

Dress Live ist eine Plattform. Partnerboutiquen sind eigenständige Unternehmen; sofern nicht ausdrücklich anders angegeben, ist Dress Live nicht Verkäufer der in der App gezeigten Artikel (siehe Abschnitt 9).

4. Teilnahme & Konto

Sie müssen mindestens 15 Jahre alt sein, um die App zu nutzen. Sind Sie unter 18, bestätigen Sie, dass ein Elternteil oder Erziehungsberechtigter diesen Bedingungen für Sie zugestimmt hat.
Für die meisten Funktionen benötigen Sie ein Konto. Sie können sich mit Ihrer E-Mail-Adresse, mit „Mit Apple anmelden“ oder mit Google Sign-In registrieren. Machen Sie zutreffende Angaben und halten Sie sie aktuell.
Halten Sie Ihre Zugangsdaten geheim. Sie sind für Aktivitäten über Ihr Konto verantwortlich; melden Sie einen Verdacht auf unbefugte Nutzung sofort an contact@ecosysteme.ai.
Sie können Ihr Konto jederzeit in der App löschen (Profil → Einstellungen → Konto → Konto löschen) oder wie auf unserer Seite zur Kontolöschung beschrieben.

5. Lizenz

Wir gewähren Ihnen eine persönliche, beschränkte, nicht ausschließliche, nicht übertragbare und widerrufliche Lizenz, die App auf Geräten, die Sie besitzen oder kontrollieren, zu installieren und für private, nicht kommerzielle Zwecke gemäß diesen Bedingungen und den Nutzungsregeln des jeweiligen App-Stores zu verwenden. Sie dürfen die App nicht kopieren, verändern, verbreiten, verkaufen, vermieten, zurückentwickeln oder dekompilieren oder ihren Quellcode extrahieren, soweit das Gesetz dies nicht ausdrücklich erlaubt.

6. Ihre Fotos & Inhalte

Alle Rechte an Ihren hochgeladenen Fotos bleiben bei Ihnen. Sie räumen uns ein nicht ausschließliches, weltweites, unentgeltliches Recht ein, Ihre Fotos und die daraus erzeugten Bilder zu speichern, zu verarbeiten, anzupassen (z. B. um ein Kleidungsstück auf Ihrem Foto darzustellen) und anzuzeigen – ausschließlich, um Ihnen die Funktionen der App bereitzustellen und sie mit Boutiquen zu teilen, die Sie auswählen. Dieses Recht endet mit der Löschung des Inhalts oder Ihres Kontos, vorbehaltlich der Aufbewahrungsfristen unserer Datenschutzerklärung.
Laden Sie nur Fotos von sich selbst hoch oder von einer anderen erwachsenen Person, die ausdrücklich zugestimmt hat. Laden Sie keine Fotos Minderjähriger außer von sich selbst hoch.
Laden Sie keine rechtswidrigen, sexuell expliziten, hasserfüllten oder rechtsverletzenden Inhalte hoch.
Wir verwenden Ihre Fotos ohne Ihre gesonderte, ausdrückliche Einwilligung nicht zum Training unserer KI-Modelle.
Wir können Inhalte entfernen, die gegen diese Bedingungen verstoßen, und in schweren oder wiederholten Fällen Ihr Konto sperren oder kündigen.

7. KI-Ergebnisse

Darstellungen und Größenempfehlungen sind Schätzungen

AI-Try-On-Bilder sind computergenerierte Simulationen. Farben, Fall des Stoffes, Passform und Proportionen können vom echten Kleidungsstück abweichen. AI Maße und Größenempfehlungen sind Schätzungen auf Basis Ihres Fotos und der Größentabelle der Boutique; sie sind keine Garantie, dass ein Kleidungsstück passt. Prüfen Sie vor dem Kauf stets die Größentabelle und die Rückgabebedingungen der Boutique und bestätigen Sie die Größe nach Möglichkeit mit der Beratung.

KI-Ergebnisse hängen von der Qualität Ihres Fotos ab (Licht, Haltung, eng anliegende Kleidung, ganzer Körper sichtbar). Wir verbessern unsere Modelle laufend, sodass sich Ergebnisse im Laufe der Zeit ändern können.

8. Live Try-On

Live-Try-On-Termine werden von Partnerboutiquen über die App angeboten. Die Verfügbarkeit hängt von der Boutique ab.
Verhalten Sie sich bei Terminen respektvoll. Belästigung, diskriminierende oder sexuelle Äußerungen oder sonstiges missbräuchliches Verhalten gegenüber Boutique-Mitarbeitenden – und seitens der Boutiquen gegenüber Kundinnen und Kunden – führen zur Sperrung.
Dress Live zeichnet Videotermine nicht auf. Sie dürfen einen Termin mit einer anderen Person nicht ohne deren Zustimmung aufzeichnen, per Screenshot festhalten oder teilen.
Die Beratung erfolgt im Namen der Boutique, nicht von Dress Live. Während eines Termins erteilte Ratschläge sind solche der Boutique.
Bitte stornieren Sie Termine, die Sie nicht wahrnehmen können, so früh wie möglich in der App.

9. Käufe bei Boutiquen

Wenn Sie über die App einen Artikel reservieren oder bestellen, kommt der Kaufvertrag zwischen Ihnen und der Boutique zustande. Die Boutique ist für Beschreibung, Preis, Verfügbarkeit, Lieferung, Rechnungsstellung, Rückgabe und Gewährleistung des Artikels nach ihren eigenen Geschäftsbedingungen verantwortlich, die Ihnen vor der Bestätigung angezeigt werden.
Zahlungen werden von der Boutique oder ihrem Zahlungsdienstleister abgewickelt. Dress Live speichert keine Kartendaten.
Ihre gesetzlichen Verbraucherrechte – einschließlich, soweit in der EU anwendbar, des 14-tägigen Widerrufsrechts im Fernabsatz und der gesetzlichen Gewährleistung – bleiben von diesen Bedingungen unberührt und werden gegenüber dem Verkäufer geltend gemacht.
Die App ist für Kundinnen und Kunden kostenlos. Dress Live bietet derzeit keine In-App-Käufe oder Abonnements für Kundinnen und Kunden an. Sollte sich dies ändern, werden Preise und Bedingungen vor jeder Zahlung klar angezeigt.

10. Zulässige Nutzung

Sie verpflichten sich, die App nicht für rechtswidrige Zwecke zu nutzen; ihren Betrieb oder ihre Sicherheit nicht zu beeinträchtigen; nicht automatisiert (Scraping, Bots) auf sie zuzugreifen oder zu versuchen, auf Konten oder Daten anderer Nutzer zuzugreifen; Anprobe-Bilder nicht zu verwenden, um sich als jemand anderes auszugeben oder jemanden zu belästigen; die App oder ihre Ergebnisse ohne unsere schriftliche Zustimmung nicht weiterzuverkaufen oder kommerziell zu verwerten; und die App nicht zur Entwicklung eines konkurrierenden Produkts zu nutzen.

11. Geistiges Eigentum

Die App, ihre Software, KI-Modelle, Gestaltung, Texte, Grafiken, Logos und der Name Dress Live gehören ecosysteme.ai oder ihren Lizenzgebern und sind durch das Recht des geistigen Eigentums geschützt. Bilder von Kleidungsstücken, Markennamen und Produktbeschreibungen gehören den jeweiligen Boutiquen und Marken. Diese Bedingungen übertragen Ihnen keines dieser Rechte. Für Sie erzeugte Anprobe-Bilder dürfen Sie für private, nicht kommerzielle Zwecke verwenden.

12. Verfügbarkeit & Änderungen

Wir bemühen uns um eine ständige Verfügbarkeit der App, können einen unterbrechungsfreien Betrieb jedoch nicht garantieren; Wartung, Updates oder Ereignisse außerhalb unserer Kontrolle können zu Unterbrechungen führen. Wir können Funktionen hinzufügen, ändern oder entfernen. Die App kann als Beta oder in einem offenen Test angeboten werden; in diesem Fall können Funktionen unvollständig sein und sich ohne Ankündigung ändern. Wir können diese Bedingungen ändern; bei wesentlichen Änderungen informieren wir Sie mindestens 30 Tage vor Inkrafttreten in der App oder per E-Mail. Nutzen Sie die App nach diesem Datum weiter, gelten die neuen Bedingungen als angenommen.

13. Beendigung

Sie können die Nutzung der App jederzeit beenden und Ihr Konto löschen. Wir können Ihr Konto sperren oder kündigen, wenn Sie gegen diese Bedingungen verstoßen, wenn das Gesetz es verlangt oder wenn wir die App einstellen – im letzten Fall mit angemessener Ankündigung. Die Abschnitte 6 (Nutzungsrecht an Inhalten für die Aufbewahrungsdauer), 11, 14 und 16 gelten nach Beendigung fort.

14. Haftung

Wir stellen die App mit der Sorgfalt eines gewissenhaften Anbieters bereit. Soweit gesetzlich zulässig, haften wir nicht für: Passform, Qualität, Lieferung oder Vertragsmäßigkeit der von Boutiquen verkauften Artikel; Ratschläge der Boutique-Beratung; Abweichungen zwischen KI-Darstellungen oder Größenempfehlungen und dem echten Kleidungsstück; Unterbrechungen durch Ihr Gerät, Ihr Netzwerk oder Dienste Dritter; sowie mittelbare Schäden wie Daten- oder Chancenverlust.
Nichts in diesen Bedingungen schließt unsere Haftung für Tod oder Körperverletzung infolge unserer Fahrlässigkeit, für Vorsatz oder grobe Fahrlässigkeit oder eine sonstige nach anwendbarem Recht nicht ausschließbare Haftung aus oder beschränkt sie – einschließlich Ihrer gesetzlichen Rechte als Verbraucher.
Sie sind für Ihre Nutzung der App und die von Ihnen hochgeladenen Inhalte verantwortlich und stellen uns von Ansprüchen Dritter frei, die aus Ihrem Verstoß gegen diese Bedingungen entstehen.

15. App Store & Google Play

Haben Sie die App aus dem Apple App Store geladen, gilt zusätzlich: Diese Bedingungen werden ausschließlich zwischen Ihnen und ecosysteme.ai geschlossen, nicht mit Apple; Apple ist für die App und ihre Inhalte nicht verantwortlich und nicht zu Wartung oder Support verpflichtet; entspricht die App einer anwendbaren Gewährleistung nicht, können Sie Apple benachrichtigen, das den (etwaigen) Kaufpreis erstattet – weitere Gewährleistungspflichten hat Apple nicht; Apple ist nicht für die Bearbeitung von Ansprüchen im Zusammenhang mit der App zuständig, einschließlich Produkthaftungs-, regulatorischer oder Schutzrechtsansprüche; Sie bestätigen, dass Sie sich nicht in einem Land befinden, das einem US-Embargo unterliegt, und nicht auf einer US-Liste verbotener oder eingeschränkter Parteien stehen; Sie halten bei der Nutzung der App anwendbare Bedingungen Dritter ein; Apple und seine Tochtergesellschaften sind Drittbegünstigte dieser Bedingungen und können sie Ihnen gegenüber durchsetzen.

Haben Sie die App über Google Play geladen, gelten zusätzlich die Nutzungsbedingungen und Regeln von Google Play. Google ist nicht Partei dieser Bedingungen und nicht für die App verantwortlich.

16. Anwendbares Recht & Streitbeilegung

Diese Bedingungen unterliegen französischem Recht. Sind Sie Verbraucher mit Wohnsitz in einem anderen Land der Europäischen Union oder in der Schweiz, genießen Sie zusätzlich den Schutz der zwingenden Verbraucherschutzvorschriften Ihres Wohnsitzlandes und können Klage vor den Gerichten dieses Landes erheben.

Bei Beschwerden wenden Sie sich bitte zunächst an contact@ecosysteme.ai – wir bemühen uns um eine Lösung innerhalb von 30 Tagen. Als Verbraucher können Sie zudem kostenlos eine Verbraucherschlichtungsstelle nach Art. L.611-1 ff. des französischen Verbrauchergesetzbuchs sowie die Online-Streitbeilegungsplattform der Europäischen Kommission unter ec.europa.eu/consumers/odr in Anspruch nehmen.
